Newly released information shows that a former top official with the Food and Drug Administration was warning Dr. Anthony Fauci of potential COVD vaccine side effects in May 2021.
Republican Sens. Ron Johnson of Wisconsin and Rand Paul of Kentucky have been sharing excerpts from Fauci’s government email that were found on his government cell phone.
The senators released a message Sunday from Dr. Janet Woodcock expressing concerns to Fauci, who at the time was the acting Commissioner of the Food and Drug Administration.
She wrote Fauci and Francis Collins, the former director of the National Institutes of Health, that she was receiving reports from individuals including “healthcare professionals” of health issues that took place after Americans were vaccinated against COVID-19.
“The symptoms do not fit together into a distinctive syndrome and most are not easily quantifiable or evaluated with standard laboratory testing,” she wrote.
“These problems are not the sort that a system like VAERS would be able to detect, or even a more sophisticated population-based active followup [sic] such as CDC has, or a medical record based system such as BEST [an FDA safety surveillance system],” she wrote.
She said a study was needed, adding, “I doubt the industry would support, for obvious reasons. But my experience is, that if you let a problem fester, then it will come back to bite you later and you are not prepared.”
Fauci wrote Collins the next day, saying “We cannot ignore her.”
The U.S. Supreme Court ruled in Brown v. Walker (1896) that a witness who has received a pardon can no longer invoke the Fifth Amendment privilege against self-incrimination for the pardoned offense. The Court reasoned that because a pardon eliminates all legal jeopardy, the individual stands “as if [the offense] had never been committed,” thereby removing the risk of prosecution that the privilege is designed to prevent.
Acceptance is required for this loss of privilege to occur. In Burdick v. United States (1915), the Court clarified that a pardon is a “deed” that must be accepted; if an individual refuses the pardon, they retain their Fifth Amendment right to refuse to testify.
Anthony Fauci, the former director of the National Institute of Allergy and Infectious Diseases, invoked his 5th Amendment right against self-incrimination on Wednesday as he appeared before the Senate Homeland Security Committee.
The committee chairman, Sen. Rand Paul, R-Ky., has accused Fauci of knowingly being involved in funding controversial gain-of-function research in China before the COVID-19 pandemic.
Repeatedly, Fauci said, “Under the advice of my attorneys, I will invoke my right under the Fifth Amendment of the Constitution to refrain from answering your questions.”
In his opening statement, Fauci accused Paul of having an “unhinged obsession” with him and said he had no choice but to invoke the 5th Amendment.
“It pains me to do so because of the respect that I have for the legislative branch of government and my decades-long record of cooperating with Congress. Under the advice of my attorneys, I will invoke my right under the Fifth Amendment of the Constitution to refrain from answering your questions,” Fauci said.
Fauci also accused Paul of publishing his private diary from his time at NIAID, a move he said was “aimed at embarrassing and intimidating me.”
“The only conclusion I can reach is that the sole reason he is calling me before this committee is to get me to say something that could vindicate his repeated public pledges that I end up, in his words, ‘behind bars,’” Fauci said.
Fauci also invoked the 5th Amendment in questions from every other Republican member of the committee.
As customary in a Senate hearing, the majority and minority members each had a chance to ask questions of the witness. Democrat members of the committee did not ask Fauci any questions, but delivered speeches in his defense.

The events of that day played out so differently that political commentator Brian Krassenstein retreated from a position he had proudly posted to social media platform X in support of Fauci when the latter, refusing to answer questions, repeatedly invoked his Fifth Amendment rights.
After the hearing unfolded the way it did, Krassenstein decided it was time to delete his post, but not before other users could screenshot it for our enjoyment.
A search on X for Krassenstein’s exact words won’t yield any results. All signs point to this being another miscalculated prediction by a prominent leftist that did not come to pass.
