It’s just temporary, but it’s good nonetheless.
The Texas attorney general is hailing a federal judge’s decision to temporarily block Obama’s executive action on immigration.
Attorney General Ken Paxton says U.S. District Judge Hanen’s Monday ruling is a win for “the rule of law in America.”
Hanen’s decision gives a coalition of 26 states led by Texas time to pursue a lawsuit that aims to permanently stop the orders, which could spare up to five million people (illegals) in the U.S. from deportation.
……The White House early Tuesday defended the executive orders, saying it was within the president’s legal authority.
Except that it’s NOT within Obama’s legal authority:
There isn’t one damned thing in the Constitution which gives a president the power to make laws at their own discretion. Article 1, Section 8 and the 10th Amendment of the U.S. Constitution, specifically outline the enumerated powers of the federal government.
Article 1 states that only Congress is authorized “To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.”
Separation of Powers and checks and balances are included in that.
The 10th Amendment in particular, is the most powerful statement of limits on the federal government:
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
That means that unless the Constitution grants a power to the federal government, the federal government does not have that power. That includes the president.
Obama hasn’t just crossed the Constitutional line since he got in office, he’s moved the goddamned thing repeatedly. He doesn’t just circumvent U.S. laws, he makes up his own and decides to enforce them.
This is not the first time Obama’s amnesty was smacked down. Last year, a federal judge in Pennsylvania ruled Obama’s tactic unconstitutional .
The great thing is, the judge used Obama’s own words:

It really sucks when your own words help clarify the unconstitutional, illegal aspects of your power-grabbing executive orders.
