Illegal Alien Rapes, Kills 64 Year Old Veteran With Hammer, Authorities Point Fingers at Each Other

A man living in the U.S. illegally has been charged in the rape and assault of a 64-year-old Santa Maria woman who later died of her injuries, authorities said Wednesday.

Victor Aureliano Martinez, 29, and another man are accused of breaking into the home of Marilyn Pharis on the morning of July 24 and attacking her with a hammer, according to police and a complaint filed by the Santa Barbara County district attorney’s office.

After the attack, Martinez escaped to a nearby home, where officers arrested him, according to the Santa Maria Police Department.

Pharis was hospitalized with “severe injuries” and died Aug. 1, police said. An autopsy was scheduled for Thursday.

Before Pharis died, Martinez pleaded not guilty to charges of attempted murder, sexual assault and burglary. He is in custody and is being held on $1-million bail, police said.

Martinez has been living in the country illegally, Santa Maria police Lt. Dan Cohen said. He has never been deported and has no prior felony criminal convictions, according to a federal official.

Yet Martinez has had prior brushes with the law.

He was arrested by the Santa Barbara County Sheriff’s Department in May 2014, when U.S. Immigration and Customs Enforcement lodged an immigration detainer on him and requested notification before his release. Martinez was released a week later without ICE receiving any notification, according to the federal official.

More recently, Martinez was arrested July 16, but ICE opted not to lodge an immigration detainer, citing his lack of felony convictions or deportations.

In a statement, ICE spokeswoman Virginia Kice said that ICE “is monitoring the case closely” and that the agency has asked to be notified if Martinez is transferred or released.

Officials have said Martinez has a long history of arrests.

Meanwhile, police have identified a second person who allegedly attacked Pharis. Jose Villagomez, who was arrested in late July on unrelated charges, was booked Wednesday on suspicion of sexual assault and attempted murder.

The Santa Maria police chief blames the feds:

……At a news conference announcing murder charges against Jose Villagomez and undocumented immigrant Victor Martinez, Santa Maria Police Chief Ralph Martin decried two state laws and also national immigration policy he says have handcuffed local law enforcement.

“I think this is a national issue,” said Chief Martin. “I think it starts in Washington D.C. with this administration that we see and their policies. I think you can draw a direct line over to Sacramento with the policies of… I’m going to say this governor and the legislature.”

“We’ve seen AB 109 pass. We’ve seen Prop 47 pass. And I am not remiss to say that, from Washington D.C. to Sacramento, there is a blood trail into the bedroom of Marilyn Pharis.”

AB 109 is a California law that changed where people convicted of a non-serious, non-violent, non-registrable sex offense felony serves time. In the past, such offenders were sent to prison; now they stay with the county where they committed the crime and were sentenced. California voter initiative Proposition 47 reduced a number of non-serious and non-violent property and drug crimes from a felony to a misdemeanor.

“There is a frustration,” added Chief Martin. “You’ve got the state of California that passed AB 109. So what happens is, the state prisons have now emptied out and are forcing all the local sheriffs to take their prisoners.”

“So two weeks before this murder, Santa Maria police officers arrested (Martinez) for possession of meth. And you know what we had to do? We had to sign him out,” said Chief Martin. “That’s the problem with this system. And it is not just in Santa Maria. This is all over the state of California and all over the United States.”

……”We can all point fingers locally at each other. ICE (Immigration and Customs Enforcement) can point the finger at the sheriff, they can point it everywhere else. But the reality is, it starts at the very top and it is not going to get fixed until it gets started at the top and reaches the lower levels,” said Chief Martin. “When the federal government and the state governments fail to do their job, it falls on the shoulders of local government. We’re not equipped to handle it financially, we’re not equipped to handle it in our jail system or anywhere else.”

The trouble with that is the states can enforce immigration laws if they choose. They don’t have to wait for approval from the feds, although you know damned well the Obama regime will never give its blessing to the apprehension, prosecution, and deportation of these shitbags. The ICE makes a habit out of refusing immigration detainers, and American citizens often pay for that depraved indifference with their lives.

Liberal policies and ‘sanctuary cities’ like the ones that infest California, contribute to the carnage committed by illegals, and the DHS, an agency that is supposed to enforce national security,  is complicit with Obama’s unconstitutional amnesty.

The rule of law means nothing to these assholes.  They assign certain unearned rights and privileges to illegals in order to add them to their constituency.

When at least one liberal elite is victimized or killed by one of the illegals they love so fucking much, this might stop.
