The Department of Homeland Security has re-issued a rule that labor unions and some business groups oppose. The “no-match” rule is intended to stop employers from hiring illegal aliens, but critics say it will have unintended consequences.The rule re-issued last week is the same one blocked by a federal district court in San Francisco last October.
The Homeland Security Department (DHS) said the newly issued “supplemental” rule addresses all three concerns raised by the court on Oct. 10, 2007.The “supplemental” rule is essentially the same as the one issued in August. In the supplemental, DHS is simply offering “a more detailed analysis of how DHS developed the No-Match policy.” DHS said the new, supplemental rule “will help responsible employers ensure that they are not employing unauthorized workers.”
Employers send the Social Security Administration millions of earnings reports every year in which employees’ names and Social Security Numbers do not match Social Security Administration records. In many cases, the Social Security Administration sends a “no-match” letter to the employer.
According to Homeland Security Secretary Michael Chertoff, the no-match rule is “an important tool for cracking down on illegal hiring practices while providing honest employers with the guidance they need. ”

Bullshit. Legal workers should have an I-9 form, for starters.
All U.S. employers are responsible for completion and retention of Form I-9 for each individual they hire for employment in the United States. This includes citizens and noncitizens. On the form, the employer must verify the employment eligibility and identity documents presented by the employee and record the document information on the Form I-9. The list of acceptable documents has been amended in the 2007 version of the Form I-9 and can be found on page 4 of the forms.
DHS admits “there can be many causes for a mismatch, including clerical error and name changes.” But it say a no-match may also flag an alien who is not authorized to work in the United States — and who may be using a fraudulent SSN.
Which means, if the illegals they hired don’t match the SSNs that were given, the I-9 forms were also fraudulent to begin with.
Leaders from worker, civil rights and immigrant advocacy organizations are blasting the Homeland Security Department for reissuing the same no-match rule that was blocked by a federal court in October. They plan to comment in a conference call with reporters on Thursday.
……Change to Win (a union group) insists that “all undocumented workers should have the same labor, employment, and civil rights protections that U.S. citizens enjoy,” and it says all workers in this country illegally “should have the right to organize into a union.”
Labor unions, immigrant rights’ groups and business groups filed suit against the no-match rule last year, saying it would burden employers and cause many authorized workers to lose their jobs, simply because of Social Security database errors.
……Labor unions argue that “no-match” letters would be used by employers to get rid of pro-union employees and defeat worker organizing.
Ah, there’s the real reason for the ‘outrage’; the corrupt, leftwing union pukes won’t be able to add illegals to their ranks. Translation: The full impact on scofflaw employers is only beginning, and the radical asshats in the unions and organizations like “La Raza” and “MEChA” are feeling the heat. Gotta love the “undocumented worker” doublespeak, too.
Illegals are not entitled to the ‘same labor, employment, and civil rights protections that U.S. citizens enjoy’, because they’re ILLEGALLY in the United States; they are NOT American citizens.
The U.S. Chamber of Commerce also opposed the No-Match Rule, saying DHS failed to “adequately consider the costs” it would impose on small businesses — including the cost of discrimination lawsuits filed by fired “no-match” workers.
