Kathryn Kimball Mizelle worked for the firm representing President Trump in the election steal and was confirmed by the Senate in November 2020, only days after the steal occurred. She was the youngest of President Trump’s nominated judges. We didn’t know she was one of the brightest and most courageous judges ever appointed.
……Mizelle, who is close to Justice Clarence Thomas, has expressed admiration for his legal philosophy and in January taught a course at the University of Florida alongside him. Tobias said the law school faculty there have spoken highly of her.
……Yesterday, Judge Mizelle ended the unscientific and senseless mask mandates put in place by tyrannical bureaucrats within the US government. Federal judge Kathryn Kimball Mizelle struck down the national mask mandate for transportation including airplanes and trains on Monday.
US District Judge Kathryn Kimball Mizelle, an appointee of President Donald Trump, ruled that the CDC failed to properly explain its decision to impose the mandate or follow proper rulemaking procedures.
……“Because ‘our system does not permit agencies to act unlawfully even in the pursuit of desirable ends,’ the court declares unlawful and vacates the mask mandate,” Mizelle wrote in her decision.
……Mizelle’s decision was in response to a July lawsuit filed by the nonprofit Health Freedom Defense Fund on behalf of two women who claimed that wearing masks on airplanes triggered or exacerbated anxiety and panic attacks.
In her 59-page ruling, Mizelle said the only remedy was to vacate the rule entirely because it would be impossible to end it solely for the two plaintiffs, writing that “a limited remedy would be no remedy at all.” The judge then remanded the matter to CDC “for further proceedings.”
……The chief executive officers of all the major airlines called on the Biden administration last month to ditch the mask mandate because the requirement did not reflect the current environment.
“It makes no sense that people are still required to wear masks on airplanes, yet are allowed to congregate in crowded restaurants, schools and at sporting events without masks, despite none of these venues having the protective air filtration system that aircraft do,” the letter from the CEOs said.
“Wearing a mask cleans nothing. At most, it traps virus droplets. But it neither ‘sanitizes’ the person wearing the mask nor ‘sanitizes’ the conveyance,” Mizelle wrote, according to The Washington Post.
And the skies echoed with cheers.
Science and common sense collaborated with the conclusion that masks do not work.
