Special counsel Jack Smith testified in a fiery, hours-long House Judiciary Committee hearing on Thursday, where he faced questions about whether or not the investigations into President Donald Trump were politically motivated.
Smith was the top prosecutor in the indictments of President Donald Trump over his alleged role in the Jan. 6 Capitol riot and a classified documents case. He was appointed to preside over the two investigations in November 2022 by then-Attorney General Merrick Garland during the Biden administration. Republicans questioned Smith on his investigation processes, while Democrats largely praised the work done by the prosecutor.
“Our investigation revealed that Donald Trump is the person who caused Jan 6, that it was foreseeable to him, and that he sought to exploit the violence,” Smith said in response to questions from Rep. Hank Johnson (D-GA).
“We followed the facts and we followed the law. Where that led us was to an indictment of an unprecedented criminal scheme to block the peaceful transition of power,” he added.
Hey Smith, you mean like the attempted coup d’état of a duly elected President by Obama, Hillary, Comey, McCabe, et al, with a fake dossier, illegal spying, lying to the FISA court, and a “Russian collusion hoax”?
Johnson asked if the charges could be resurrected after Trump leaves office, however, Smith said “they were dismissed without prejudice” and said he cannot speak on whether the charges could be brought back.
Republicans took aim at the reported use of phone records of lawmakers, like Kevin McCarthy, in the investigation. For example, Rep. Chip Roy (R-TX) said that his phone records were “indeed targeted” because of his communications with Rep. Scott Perry, which Smith said happened before he took over the investigation from his understanding. Roy asked if there were any limits to Smith’s investigation, saying it unfairly targeted conservatives and people who backed the president.
“To what end, would conversations between the Speaker of the U.S. House, second in line to be the president, and the president, on what basis would it be any of your business other than you believe there was a conspiracy without conspiracy as a basic premise?” Rep. Darrell Issa (R-CA) said to Smith.
“You, like the president’s men for Richard Nixon, went after your political enemies. Maybe they’re not your political enemies, but they sure as hell were Joe Biden’s political enemies, weren’t they? They were Harris’ political enemies. They were the enemies of the president and you were their arm, weren’t you?” he added.
During Thursday’s hearing, while being questioned by Rep. Becca Balint (D-VT), Smith claimed he believes that the Justice Department will try to indict him in retaliation. Smith later said that the president wanted to “prey on party loyalty.”
Whining about retaliation is pretty funny considering Biden weaponized government agencies against Trump, his supporters, and dispatched the FBI to homes of citizens who spoke out against the Biden regime.
“Our investigation involved interviewing and subpoenaing records of Republicans because that’s who Donald Trump sought to prey on to stay in office,” Smith said.
……..Other lines of questioning from Republicans also commented on perceived political bias in the investigations.
“You [were] unconstitutionally appointed. You breached the 60-day rule releasing this very partisan attack against the president right before the election. You tampered with evidence in the Mar-a-Lago case that you admitted to in court filings. You subpoenaed members of Congress and their phone records in violation of the Constitution, of current statute, you didn’t even let the court know these were members of Congress. How are we to assume otherwise this wasn’t political? Because it absolutely was,” Rep. Russell Fry (R-SC) said at one point.
Rep. Dan Goldman (D-NY) fired back against the use of claims from Trump-appointed Judge Aileen Cannon, calling her “completely lawless.”
In addition, Chairman Jim Jordan (R-OH) slammed the witness testimony of former White House staffer Cassidy Hutchinson, saying, “That’s the degree the Left and Democrats were willing to go to get President Trump. Putting on the witness stand somebody everybody knows is making it up.” Smith said Hutchinson’s claims were “secondhand” accounts.
Rep. Brandon Gill reduced Smith to a stuttering pile of mush when he tried to lie his way out of an explanation about his unjustified subpoenas of political opponents’ phone records.
…..Smith secretly obtained the phone toll records of 8 Republican senators and a few members of the House, which covered January 4-7, 2021.

GILL: We’re not gonna delay like this. How many days after Kevin McCarthy was sworn in as Speaker did you subpoena his records?
SMITH: Uh, I don’t recall, but those two things had nothing to do with one another.
GILL: It was 16 days after becoming the highest ranking Republican in the House of Representatives, you subpoenaed his toll records. Do you agree that that might reasonably be considered a violation of the Speech or Debate Clause?
SMITH: Uh, I do not.
GILL: At the time you, you secured those non-disclosure orders, was Speaker McCarthy a flight risk?
SMITH: He was not.
GILL: He was not. Then why did your non-disclosure order refer to him as a flight risk? It says right here, ‘The court finds reasonable grounds to believe that such disclosure will result in flight from prosecution.’ You were using clearly false information to secure a non-disclosure order to hide from Speaker McCarthy and from the American people the fact that you were spying on his toll records.

ROY: I’m thankful for the great staff who discovered the email where I learned for the first time a few weeks ago that my phone records were indeed targeted. As egregious as a violation of separation of powers this is, as an egregious and abuse of power it is, it’s far more concerning you are clearly targeting American citizens for merely being conservative or supporting the President.
SMITH: I’m sorry.
ROY: The indictment involving classified documents was dismissed after determining your appointment violated the Appointments Clause of the Constitution, but you continued to sign your name on court filings until the time you resigned from office. A federal judge just recently stated a prosecutor who continues to sign his name in court filings after a disqualification order should face disciplinary action or disbarment.
Smith never thought he would be held accountable for his ruthless attack on a president. No one in the Biden administration did.
Accountability should come in the form of indictments, trials, and convictions. That’s accountability. Anything less is bullshit.
……..Jack Smith admitted that he targeted Trump with flimsy evidence that he knew was bogus, knowingly violated the law by spying on members of Congress, intentionally withheld names from Judges to obtain search warrants for GOP lawmakers, and that he wasn’t properly sworn in as Special Counsel. And it was all to stop the leading Presidential candidate from returning to the White House after the election was stolen.
President Trump responded after the hearing, calling for Jack Smith to be prosecuted for weaponizing the DOJ and for perjury. “Based on his testimony today, there is no question that Deranged Jack Smith should be prosecuted for his actions. He destroyed the lives of many innocent people, which has been his history as a prosecutor,” Trump said on Truth Social following Smith’s testimony.

Smith violated the same law as J6 defendants who were sent to prison for years—-18 U.S.C. § 1512(c)(2).
He met with Biden aides before the bogus classified documents charges were brought. Smith’s team admitted in a motion filed with the U.S. District Court in the Southern District of Florida that key evidence seized during the FBI raid on former President Donald Trump’s Mar-a-Lago estate in August 2022 was manipulated. The lawfare against Trump was orchestrated by the Biden regime. In a blatant act of prosecutorial misconduct, Alvin Bragg hid hundreds of pages of exculpatory evidence from the NY grand jury.
Smith spent over $50,000,000 to plant evidence against Donald Trump. The FBI brought classified cover sheets to place over the classified documents found at Mar-a-Lago and took photos for evidence. Tampering with evidence is a third-degree felony, punishable by 2 to 10 years in prison and fines up to $10,000. When’s the prosecution?
